  [Failed] Discretionary Powers Act (October 2020)

Shareholders of Lazarus,

A motion and a second have been received for the Discretionary Powers Act (October 2020). This is a vote on a law bearing the same legal weight as the  Mandate. As such, it requires a three-quarters supermajority to pass. The discussion thread can be found here.

As per Assembly Procedure Act 1.5, this vote will last for 5 days, ending on October 15th, 3:51 PM EST. Citizens may vote "Aye" or "For," "Nay" or "Against," or "Abstain" or "Present".

Section 1. Constitutional Status

(1) This act will bear Constitutional Status and will be subject to the voting thresholds thereof.

Section 2. Application

(1) The powers enumerated herein will not apply to any law holding Constitutional Status nor the Mandate of Lazarus.

Section 3. Discretionary Powers

(1) The Speaker may rectify any formatting inconsistencies of passed legislation, including:

a. Legislation which is not in compliance with any of the rules for the formatting thereof,
b. Numbering inconsistencies within any legislation,
c. Inconsistencies with BBcode of any legislation,
d. Any other change that may be reasonably deemed to be categorized as an issue with the formatting of any legislation.

(2) The Speaker may rectify any minor grammatical and spelling inconsistencies of passed legislation.

(3) The Speaker may substitute any terms that may be reasonably deemed outdated in terms of the Laws of Lazarus with an updated term.

Section 4. Promulgation and the right of Veto

(1) The Speaker must publicly promulgate any use of powers enumerated herein within 24 hours thereof.

(2) If any Citizen tables a motion to Overturn the decision of the Speaker and another Citizen seconds the relevant motion, then the relevant use of the powers enumerated herein will be rendered unenforceable pending a vote in the Assembly;

a. The relevant vote can be held after a minimum discussion period of 3 days, but will be held after a period of 7 days,
b. The vote will last for 5 days and if the nays outnumber the yeas then the relevant use of the powers enumerated herein will be repealed.

Section 5. Delegation of powers

(1) The Speaker may not delegate the use of the powers enumerated herein to their deputies or any other person.

Section 6. Definitions

(1) "Outdated term" - Any word or phrase that has been rendered obsolete by new legislation.

Preamble
This act defines the procedure by which the Court shall conduct Criminal Reviews in accordance with Article V Section 7 of the Twelfth Mandate.

Section 1. Petitioning the Court

(1) Petitions to conduct a Criminal Review shall:

a. be submitted to the Court in a public area,
b. identify a Defendant,
c. identify the crimes the Defendant is alleged to have committed and
d. include evidence and commentary thereof in support of the allegations.

(2) The Court shall consider the petition for three days before deciding whether to conduct a Criminal Review by two-thirds vote.

(3) Upon two or more justices deciding to conduct a Criminal Review, the Court shall immediately serve notice upon both the Plaintiff and the Defendant that a Criminal Review has begun and refer them to this document.

(1) Criminal Reviews shall be conducted in a public area.

(2) Once the Criminal Review has begun:

a. the Defendant shall be granted seven days to present evidence in their defence and commentary on all evidence submitted to the Court thus far
b. then the Plaintiff shall be granted four days to present further evidence and commentary on all evidence submitted to the Court thus far. After this, the Criminal Review will conclude.

(3) The Plaintiff and the Defendant may each be represented by another person who they may identify at any time. Each of them may be represented by only one person at any given time.

(4) Criminal reviews shall only require two justices to hear a case, except in the case of a criminal review appeal.

Section 3. Criminal Review Appeals

(1) Criminal Review appeals shall be conducted in a public area, with the same procedure as a Criminal Review.

(2) Criminal Review appeals shall be conducted with all three justices, and shall be the final court judgement on a case.

First off I would like to state that I know the court is sort a member so if they cannot come to a decision on this question I am fine with them deferring to a latter date. I just ask that they inform me about that.

The criminal code uses "Any person" when defining crimes, so does this language include people who are non-residents of Lazarus at the time the crime was committed, and therefore not under the jurisdiction Lazarus? That is to say, can non-residents be charged with crimes in Lazarus?
