  Reduction In Punishment (June 2020)

Shareholders of Lazarus,

A motion and a second have been received for the Reduction in Punishment (June 2020). This is a vote on reducing a punishment decided by the court. As such, it requires a three-quarters supermajority to pass. Citizens may vote "Aye" or "For," "Nay" or "Against," or "Abstain" or "Present".

The time allotted for this vote is five days. Voting will end on the 24th of June, 2020, at 9 PM EST.

On June 11th, 2020 Vedan was found guilty of Conspiracy to Commit Misconduct. He was sentenced on June 14th, 2020. The Assembly of Lazarus, having found this sentence absurd, hereby enacts this Reduction of Sentence.

Section 1. Reduction of Sentence

(1) Vedan's sentence currently reads:

[table][cell]Vedan is to be banned from membership of the Regional Guard for 18 months, banned from holding public office for 8 months and shall have their voting rights suspended for 2 months. They may apply to have their Regional Guard ban commuted after 12 months and their ban from public office commuted after 6 months.[/cell][/table]

(2) A Reduced Sentence shall read:

Desiring friendship between Lazarus and Thalassia, both parties hereby ratify this treaty.

Section 1. Recognition

 (1) Thalassia recognizes the government of Lazarus set forth in the Twelfth Mandate of Lazarus.
 (2) Lazarus recognizes the government of Thalassia set forth in the Constitution of the Kingdom of Thalassia.
 (3) Both parties pledge to recognize each others’ legal successor governments as the legitimate government of their respective region.

Section 2. Pact of Non-Aggression

 (1) Both parties pledge to not declare war on the other.
 (2) Both parties pledge to not knowingly conspire to or raid or otherwise attack the possessions or home region of the other, and to inform the other of a pending attack or raid on their home region or possessions, post haste.
 (3) Both parties agree that the deployment of military forces on opposing sides, in a region that is not the home region nor possession of the other, is not a violation of this treaty.
 (4) If both parties agree, they may conduct joint-military training with the other, and such action is not a violation of this treaty.

Section 3. Cultural Cooperation

 (1) Both parties will endeavor to seek cultural cooperation when appropriate.

Section 4. Diplomatic Cooperation

 (1) Both parties pledge to maintain on-site and off-site embassies and to send diplomatic envoys to the other.

Section 5. Pact of Friendship

 (1) Both parties recognize the close relationship and friendship between them.

Section 6. Termination and Amendments

 (1) All amendments made to this treaty will be made through bilateral negotiation and agreement.
 (2) If either party wishes to terminate this treaty, they may do so by informing the other, and in such an event, the treaty will hold full effect for two weeks and during this period the respective party may withdraw their termination order.

Security Reviews Amendment (2020)

Preamble

This amendment shall enable for the establishing of a formal process for security reviews of those banished from Lazarus. 

Section 1. Amendment of the Twelfth Mandate of Lazarus

(1) Section VI. Council of Lazarene Security shall be amended to also include:

(1) The Council of Lazarene Security shall permit security reviews of the regional ban list related to in-game activity, within 6 months of banishment, if so ordered by the Court of Lazarus.

(2) In process of a security review, the Court of Lazarus shall review evidence of good character to be presented to the Council of Lazarene Security, giving their approval for the review to go ahead. The procedures for approving of a review may be established by a two thirds vote of the Assembly.

(3) Revoking banishment by process of security review shall require a 50%+1 vote of the Council of Lazarene Security to be implemented, and approval of the Delegate of Lazarus.

(1) Section V. Court of Lazarus, Powers of the Court, shall be amended to also include:

The Assembly may overturn or reduce such punishments by three-quarters vote, and guilt and sentencing guidelines may be further defined in law by a two thirds vote of the assembly.

Section 1. Amendment of the Criminal Code Act

  Is an armistice reconcilable with an existing war resolution?

I hate creating more work for the court. Unfortunately, there is nothing in law providing for an armistice or mentioning it, and it is being advocated as a measure where the government may sign off on a measure to stop military engagements with the NPO.

This could require:
- A vote to repeal the declaration of war by two thirds vote.
- A vote only to approve an armistice by two thirds vote.
- Recognition that the government has the power constitutionally to suspend carrying out aspects of a war resolution, rather than just informally not taking actions against the NPO.

So for the future we will need clarification on the powers granted to a government versus the power of the assembly to charge a government to implement a war resolution.

Would an armistice be reconcilable with existing laws/resolutions passed by the assembly such as a war resolution?
