Shareholders of Lazarus,

@"joWhatup" has been appointed to serve as Director of Public Relations. As per Mandate 12 IV.6, this appointment is subject to a simple majority confirmation by the Shareholders of Lazarus.

Hi all,

I know I haven't talked much here, but I've been reading about the laws here and generally how things work for a little while and I had one major question: why is there no democracy here? It's something that I've found interesting, especially since Lazarus is one of the biggest regions in the entire world, and that's a lot of nations to be ruled with no democratic shift in power! I also noticed that we have a system of corporate governance in this region, and I know that even corporations typically elect the CEO either from the board of directors or (in some situations) the shareholders, so I have been curious as to why we don't do it here too. It's just something I was curious about! Thanks for any input! Smile

Heiress Apparent Confirmed: Recently Pharaoh Anabelle confirmed Rigel as the Heiress Apparent in Osiris. The position will serve as Delegate if Anabelle steps down and serves in her place. In the confirmation thread, Anabelle had this to say:

New Treaty: Osiris and The East Pacific recently ratified a new treaty named The Treaty of Tranquility. The West Pacific

A New Manners: The West Pacific recently made internal changes to their government system and processes. Specifically, they consolidated the ministries of the region. They now function with four ministries: Cultural Affairs, World Assembly & Recruitment, Foreign Affairs, and Military Affairs. Additionally, they’ve recently established a new regional university which is now working with its first round of students. Deputy Elections: With the new changes to the Manners of Governance and the changers to ministries, TWP held their first election cycle for the Deputy positions within their government. You can few the full results of the elections here: https://www.nationstates.net/page=dispatch/id=1318187

Festivities: The West Pacific just wrapped up an international festival called Festival of the Three Perfections. The event was the second of their annually-held, arts-focused festival/competition that was open to any region in NationStates to participate. I spoke with Minister of Community Affairs Fujai who worked to organize the event on more details about what it was and their thoughts:

“It's based on the Three Perfections of Chinese art, which refers to a gathering of poetry, calligraphy, and painting in a single artwork. For our purposes, we modified them to Poetry, Writing, and Art, with three additional categories in each (free verse, haiku, and limerick in poetry; handwriting, essay, and short story in writing; and graphic design, photography, and sketches and paintings in art)

Of all the annual and one-off festivals TWP holds, this one is my favorite because I get to see all the amazing creations people from across the NSVerse put together. It's really incredible to see so much creative power in one place. While there are winners, the true goal of the festival is to foster the creative energies of NS in an inclusive and welcoming environment where everyone can enjoy the presence of others”

Preamble

This act will set forth the general procedure for private information being released to the public.

Section 1. Freedom of Information Requests

(1) Preceding Definitions:

a. Requesting entities are described as individuals, groups, and organizations, as well as foreign or local media,
b. Relevant officials imply the Assembly Speaker, the Prime Minister, or the Delegate and Vice-Delegate, where they have jurisdiction. 

Section 2. Request Procedure

(1) Requesting entities must post a request, with reason(s) for the request, and the preferred date of release:

a. Once a request is received it shall be processed within a timely manner not exceeding 72 hours,
b. Requesting entities that are citizens need not file a request to quote non-personally identifiable information.

(2) Requests may declined or information omitted for the following reasons:

a. Sensitivity of the information requested, inclusive of regional security and online privacy,
b. Too broad a scope of a request, inclusive of requiring an undue burden of information,
c. Release of the information would break existing laws or treaty obligations.

Section 3. Permitted Release of Information

(1) Requests for release official documents or discussions, may be permitted so long as:

a. They have been cleared for release by the relevant officials, and forum and discord administration,
b. The request is for a general overview of a discussion or document, where if it is of a sensitive nature.

(2) Requesting entities may request or quote non-personally identifiable information, which shall include:

a. How many have voted for a candidate or proposal, during or after the vote was held,
b. Analysis of public feelings surrounding a proposed law, treaty, or candidate.

(3) Private communication may be released, if the parties consent, within reason.

Section 4. Acknowledgment of the Criminal Code

(1) Not following this process to release private information may permit legal sanction under the Criminal Code of Lazarus.

a. This request shall include the reason(s) for the request, what information is requested, and the preferred date of release,
b. Once a request is received it shall be processed within a timely manner not exceeding 72 hours,
c. If the information requested does not pertain to the Assembly, the Assembly Speaker will notify the parties involved,

(2) Notification of parties shall be by posting in a designated forum topic or by private messaging:

a. In the case of cabinet information, it shall be to the Prime Minister,
b. In the case of the Council of Lazarene Security, it shall be to the Vice Delegate,
c. In the case of Court, it shall be to a justice of the Court of Lazarus.

(3) If the parties agree to release the information without delay, it shall be released within 72 hours or at such time it has been requested for release, where possible.

(4) If the parties do not agree to a full release, they must provide reasoning in the designated forum topic for declining the request or for any redaction(s) of information:

a. Appropriate reasoning shall include personal information at risk, general refusal of consent by the parties involved, or refusal of consent by a foreign entity in relation to a treaty in process of negotiation. 

(5) If a request has been made for the same private information, the first request shall take precedence as to not overburden authorities with requests.

Section 3. Appeals Process

(1) If a request is rejected it may be appealed to the Court of Lazarus where:

a. It relates to reasons of personal information at risk or general refusal of parties involved.

(2) The Court of Lazarus shall be empowered to decide the general procedures of this process:

a. It shall decide the number and scope of appeals that are permitted for a specific request,
b. It may order private information released or released with redaction(s), upon a successful appeal, within 72 hours,
d. It may uphold the refusal, in which case if another requesting entity makes a request for the same information it may result in an automatic refusal.

Section 4. Exceptions

(1) Off-Site Administration and the Assembly Speaker may also decline a freedom of information request or redact information when:

a. Releasing said information may cause OOC risks to persons or the region, such as imperiling their safety or privacy.

(2) Private Messages may be released upon approval by the Vice-Delegate, Assembly Speaker or Prime Minister, if the parties involved in the conversations agree to release the requested information.*

Section 5. Acknowledgment of the Criminal Code

(1) Not following this process to release private information may permit legal sanction under the Criminal Code of Lazarus. 

*Note: Vice-Delegate chairs the CLS, Assembly Speaker chairs the Assembly, Prime Minister chairs/decides the Cabinet, so that's why these are specifically mentioned.[/spoiler]

Preamble

Desiring friendship and tranquillity between Lazarus and the South Pacific, both parties ratify this treaty and thereby affirm their mutual respect.

(1) Both signatories recognize the government of the Coalition of the South Pacific as set forth in the Charter and the government of Lazarus as set forth in the Twelfth Mandate as the legitimate ruling bodies of their respective regions.

Section 2. Pact of Non-Aggression

(1) Both signatories pledge not to declare war against one another.

(2) Both signatories pledge not to endeavor, conspire or withhold knowledge of any third party's intentions to invade, raid or otherwise attack their counterpart's home region or possessions.

(3) Both signatories pledge not to direct or encourage any person to adopt false pretenses in their counterpart’s on-site or off-site property.

(4) Both signatories reserve the right to deploy military forces to regions other than their counterpart's home region and possessions when on opposing sides in military gameplay.

Section 3. Cultural and Diplomatic Ties

(1) The governments of both parties pledge to seek cooperation on cultural matters.

(2) Both signatories will maintain in-game and off-site embassies with each other and will maintain diplomatic representatives in each other’s regions.

Section 4. Amendment, Interpretation, Display, and Repeal

(1) All amendments to this treaty must be made bilaterally following negotiations between signatory governments.

(2) The parties to this treaty may clarify the terms of this treaty through memorandums of understanding, which shall be posted alongside the treaty.

(3) Should either signatory state voluntarily disband without leaving a legal successor or dissolve this treaty in accordance with their own laws, both parties shall be relieved of the commitments made herein.

(4) This treaty shall be displayed in a publicly accessible area of the community forums of both parties.

  [Discussion] Discussion of the Potential for Radical Change

To those of you who may not know who I am, I represent the nation known as the Zapatian Workers State, although you can simply call me ZWS. In my past experiences, attempting to meddle with the current organization of Lazarus is a futile attempt, as the current manifestation of the Lazarene state was agreed upon by a broad majority, and considering that Lazarus has been shocked to the core of its institutional foundations before by coups d'etat and hostile conspiracies. With that said, and keeping in mind that my previous efforts to "go against the grain" on mixing things up have not been well-presented or well-received, I would like to hold a discussion on whether the active majority invested into the workings of this region think that substantial institutional reorganization, as opposed to adding layers of bureaucracy in the name of formality, is possible in the prevailing climate, or even desirable.

For an indicaton of the types of ideas I would like to see legislated, I have:

1) Called for an end to the policy of official neutrality in military conduct
2) Called for the guard to be made subordinate to the office of the Managing Director for better coordination with foreign policy objectives
3) Called for the creation, whether as a subdivision of the guard or as a separately chartered state apparatus, a corps to collect information and conduct espionage operations
4) Called for an act to enable the Managing Director to deploy the guard on a limited basis to react more promptly and effectively to aggression of enemy powers if needed, prior to and contingent for long-term extension upon the 2/3 vote for a declaration of war in the Assembly.

I realize that these ideas are seen as... um... wacky by the more pacifistically-minded people of Lazarus, but just out of curiosity I was wondering if there could be any room for compromise or point of agreement, however marginal, so that I could potentially see some small part of this program consummated in the near-future.
