Criminal Code Act Amendment (June 2020)

Preamble

In order to facilitate the assembly to have the ability to pass sentencing guidelines with sway on sentences in criminal cases.

Section 1. Amendment of the Criminal Code Act

(1) Section 13 shall be amended to read:

Section 13. Guilt and Sentencing

(1) No person may be found guilty of a crime not listed in this act.

(2) If found guilty of a crime, the Delegate may impose upon the person any punishment proportionate to the offence.

(3) Guilt and sentencing guidelines may be further defined in law by a two thirds vote of the assembly.
