Regulation of States of Emergency

Preamble

This constitutional law will more clearly define a state of emergency and apply regulation towards the use of a state of emergency.

Section 1. Definitions

(1) A state of emergency shall refer to an instance in which the Delegacy of Lazarus is threatened by an illegal attempt to overthrow the Delegacy or otherwise overturn the legitimately established Delegate of Lazarus under the mandate.

(2) A state of emergency can also be considered warranted if the Delegate has ceased to exist while in office or 28 days have passed with no logged in activity in Nationstates.

(3) A necessary measure implemented to protect the Delegacy of Lazarus shall be restricted to a vote concerning the endorsement limit, or concerning the residence or citizenship of hostile organizations, regions, or nations within Lazarus.

(4) Hostility shall be specifically defined as any organization, region, or nation that seeks or takes efforts to overthrow the legimately established Delegate of Lazarus under the mandate.

Section 2. Implementation of a State of Emergency

(1) Any citizen may appeal to the Delegate or to the Council of Lazarene Security to implement a state of emergency so long as it meets the definition of what warrants a state of emergency.

(2) The Council of Lazarene Security may then vote to declare a state of emergency by two-thirds vote.

(3) A state of emergency shall not suspend the mandate or the Assembly.

Section 3. Necessary measures of a state of emergency

(1) The Assembly Speaker shall be permitted to reduce or eliminate the discussion period to rush a necessary measure to vote, so long as:

a. It is a measure implemented to protect the Delegacy of Lazarus and does not suspend the mandate.
b. It does not supersede, override, or take powers from existing institutions, inclusive of the Council of Lazarene Security or the Court of Lazarus.

(2) The Council of Lazarene Security shall be empowered to impose revocation of citizenship, ejection and/or ban from Lazarus without authorization from the Delegate, and the Delegate may at any time suspend or invalidate a vote that has occurred without their authorization.

(3) The Council of Lazarene Security shall be empowered to vote upon endorsement limits without authorization from the Delegate, and the Delegate may at any time suspend or invalidate a vote that has occurred without their authorization.

(4) In absence of the Delegate of Lazarus, the Court of Lazarus shall be empowered to stay or limit the revocation of citizenship, ejection and/or ban from Lazarus by the Council of Lazarene Security.

(5) The Court of Lazarus shall be empowered to stay or limit measures rushed to vote in the Assembly for review of their legality or to otherwise revoke measures deemed unconstitutional under existing Lazarene law.

Section 4. Ending a State of Emergency

(1) Any citizen may appeal to the Delegate or the Council of Lazarene Security to end a state of emergency.

(2) The Council of Lazarene Security may then vote to end a state of emergency by two-thirds vote.
