Criminal Procedure Act Amendment (October 2020)

Preamble

This act defines the procedure by which the Court shall conduct Criminal Reviews in accordance with Article V Section 7 of the Twelfth Mandate.

Section 1. Petitioning the Court

(1) Petitions to conduct a Criminal Review shall:

a. be submitted to the Court in a public area,
b. identify a Defendant,
c. identify the crimes the Defendant is alleged to have committed and
d. include evidence and commentary thereof in support of the allegations.

(2) The Court shall consider the petition for three days before deciding whether to conduct a Criminal Review by two-thirds vote.

(3) Upon two or more justices deciding to conduct a Criminal Review, the Court shall immediately serve notice upon both the Plaintiff and the Defendant that a Criminal Review has begun and refer them to this document.

Section 2. Criminal Reviews

(1) Criminal Reviews shall be conducted in a public area.

(2) Once the Criminal Review has begun:

a. the Defendant shall be granted seven days to present evidence in their defence and commentary on all evidence submitted to the Court thus far
b. then the Plaintiff shall be granted four days to present further evidence and commentary on all evidence submitted to the Court thus far. After this, the Criminal Review will conclude.

(3) The Plaintiff and the Defendant may each be represented by another person who they may identify at any time. Each of them may be represented by only one person at any given time.

(4) Criminal reviews shall only require two justices to hear a case, except in the case of a criminal review appeal.

Section 3. Criminal Review Appeals

(1) Criminal Review appeals shall be conducted in a public area, with the same procedure as a Criminal Review.

(2) Criminal Review appeals shall be conducted with all three justices, and shall be the final court judgement on a case.

(3) Criminal Review appeals may be dismissed by all three justices if they hold there are no grounds for a criminal review appeal.

Treaty of the Sun
A treaty to define the fraternal and amiable form of the relationship between the regions of Lazarus and Osiris.

Article 1: Recognition

(1) The Osiris Fraternal Order and its legal successors shall recognize the government established by the Twelfth Mandate of Lazarus and any of its legal successors as the legitimate government of the region of Lazarus.
(2) The government established by the Twelfth Mandate of Lazarus and its legal successors shall recognize the Osiris Fraternal Order and any of its legal successors as the legitimate government of the region of Osiris.
(3) Should the government of a signatory voluntarily disband while in exile, the other is freed from the commitments of Article 1, Sections 1 and 2. Additionally, if the new government refuses to recognize this treaty, it is automatically dissolved.

Article 2: Pact of Non-Aggression

(1) Both signatories hereby pledge to not invade, raid, or otherwise attack the other’s region or any possessions they may have, nor aid any faction, government, or party to do so.
(2) Both signatories agree that the deployment of military forces on the opposite side of the other in another region that is not the possession of either does not constitute aggression against either of the signatories.
(3) If planned and agreed upon by the governments and military forces of both signatories, both military forces may engage in offensive raiding or defending action against each other for training purposes, or for their mutual pleasure.

Article 3: Mutual Defense

(1) Both signatories pledge to defend one another militarily against any invasions or similar crises they may suffer.
(2) Both signatories pledge to send any military forces they possess at the request of the other in order to facilitate legitimate delegacy transitions, or in cases of emergency.
(3) Both signatories agree that they shall not aid an enemy at war with the other. If a region declares war on one of these signatories, the other may only choose to stay neutral or aid the signatory in question.
(4) If one of the signatories does not possess any military forces and is called upon the other by the provisions set in Article 3, Sections 1 to 3, they must assemble a military force at the earliest opportunity.

Article 4: Protection Against Infiltration

(1) Both signatories pledge to inform the other’s government and any relevant intelligence services of any evidence they may have of espionage, infiltration, subversion, manipulation, or conspiracy against the other. They shall also inform the other of any conspiracies to commit any crimes in the other’s jurisdictions.
(2) Both signatories pledge to cooperate on matters of intelligence and security.
(3) Both signatories pledge to punish any of their citizens convicted by the other of acting against the other signatory through espionage, infiltration, subversion, manipulation, or conspiracy. They may choose to hold a trial for any of these crimes, or punish the individuals outright. In the latter case, both governments must negotiate any punishments to be given to the individuals in question.
(4) Both signatories shall condemn any acts of espionage, infiltration, subversion, manipulation, or conspiracy against the other if the target of these acts confirm it.
(5) Both signatories pledge to never commit acts of espionage, infiltration, subversion, manipulation, or conspiracy against the other, or aid any faction, government, or party to do so.
(6) If the government of any of the two signatories fail to fulfill the obligations of Article 4, Sections 1 to 5, they must formally and publicly apologize for this.

Article 5: Cultural Cooperation

(1) The relevant cultural authorities of both signatories shall actively cooperate on matters of culture, which may include festivals, games, roleplays, mafia, newspapers, radio shows, podcasts, graphic design, and others. At least one of these must be done annually as a bilateral event, unless in times of emergency. Furthermore, the relevant cultural authorities of both signatories are encouraged to do more than the required one bilateral event per year.
(2) The relevant cultural authorities of both signatories are encouraged to plan and cooperate on a festival celebrating the passage of this treaty.
(3) Citizens of Lazarus and Osiris are welcome to visit the other’s region and engage in events of cultural significance and to have fun with the other’s community.

Article 6: Provisions of Ratification, Amendment and Repeal

(1) Both signatories shall activate their legal mechanisms relevant to ratify a treaty after they agree to do so.
(2) If a signatory wishes to amend this document, they must negotiate with the other to do so. After this, the same legal mechanisms in each region relevant to ratify a treaty shall be activated to adopt these agreed amendments. If one region refuses these amendments, they are to not be adopted.
(3) If a signatory wishes to dissolve this treaty, they must notify, by any means of communication available and possible, their intention to dissolve said treaty to the other. After this, the legal mechanisms relevant to dissolve a treaty shall be activated in the region of the requesting signatory.
(4) The signatories may dissolve this treaty by mutual consent. The legal mechanisms relevant to dissolve a treaty must be activated, and if at least one region decides to repeal, the treaty is declared null and void with immediate effect.

Desiring once more that there shall be lasting peace and friendship between Lazarus and The West Pacific, this treaty is declared to be agreed upon by the governments of both regions, broadening and rejoicing in both the present and future friendship between the two regions. Each region shall respect the independence, sovereignty, and principles of the other and refrain from interfering in the internal affairs of the other, working only toward the betterment of each.

Article I - Recognition of Sovereignty

A. The members of this treaty recognize the independence and sovereignty of the current government of each region and agree to recognize any legal government that follows.
B. The current and thus legal governments as of the time of the signing of this treaty are the Twelfth Mandate of Lazarus, ruling over Lazarus, and the Delegate of the West Pacific, ruling over the West Pacific, as per The Manners of Governance.
C. Both regions recognize that the sovereignty of each region is vested in the preferred system of each of the legal governments.
D. Both regions agree not to take up arms against one another, nor undertake any action that is aimed at the subversion of the legitimate government of either region.

Article II – Mutual Defense

A. Signatories of this treaty agree to provide defense for one another and may call on each other in times of crisis, or any other circumstance that is deemed a threat to the legal governments of either region.
B. Such defense is not limited in scope, and the regional governments of both regions may request any form of help that they feel is necessary in trying circumstances, which can include everything from a statement by the other regional government, to a call for military assistance.
C. A Request for military assistance may only be filed by the legal government of each region.
D. If one region makes what would be considered an unachievable demand of military resources from the other during a time of crisis, such as due to demanding more resources than can be reasonably fulfilled by the assisting region, then the assisting region may respectfully reject the request but may offer a counter negotiation of resources and act accordingly in a good faith effort to offer what aid can be given from its available resource reserves.
E. If one region comes into possession of intelligence that could put the other region at risk, such information must be reported to the other regional government’s officials as quickly as possible. Any information shared between the parties of this treaty will be kept confidential to the greatest capability of both regional governments, and such information will not be presented publicly unless the regions have both agreed.

Article III – Military Cooperation

A. Signatory regions shall not engage in military hostilities against each other. This includes direct military operations against each other's sovereign territories and engaging in military operations in assistance of a belligerent, opposing force of the other region.
B. Individual military operations do not need the approval of the other region as long as it does not violate Article III, A.
C. The signatories of this treaty agree to the principle of military cooperation, and agree to work together militarily to if they so wish it and if it is possible.
D. Both regions agree to recognize that the militaries of each regions are independent entities, protected under the right of sovereignty, and that they may engage each other on opposite sides of the battlefield in typical military gameplay; moreover, such engagements should not offend either region, but be greeted with respect in the spirit of competition.
E. Though strongly encouraged, neither region is obligated to participate in any military operation of the other, with the exception of the mutual defense agreements spelled out in this treaty.

Article IV – Diplomatic Cooperation

A. Each signatory will endeavor to provide diplomatic support to the other signatory, where it is possible for them to do so, while being consistent with their own internal policies.
B. Signatory regions shall provide an embassy for the other signatory on their forums and shall provide a representative from their region who will act as an ambassador from their region.
C. Each signatory will endeavor to keep the other up-to-date on their regional affairs.
D. Each ambassador shall behave in a respectable manner towards the signatory region. This includes, but is not limited to, obeying regional laws where it is applicable and following any ambassadorial protocol that the signatory region has already in place.
E. Either signatory region may request that the ambassador sent to them by the other signatory be replaced if it is deemed that clauses IV.C or IV.D have not been followed appropriately by that individual.
F. If either signatory region cannot fulfill the request as stated in Article IV.E, both regions may discuss and negotiate an alternative solution to the issue.

Article V – Cultural Activities

A. Each signatory will endeavor, where appropriate to engage in social and cultural activities with the other signatory. This can include, but is not limited to, festivals, competitions, and other shared events.

Article VI – Termination of Treaty

A. If either regional government is considering withdrawal from this treaty, representatives from both regions must first meet and make a good-faith effort to find a solution to the issue(s) causing withdrawal.
B. If that good-faith effort fails, then either member of this treaty may withdraw at their discretion.
C. There will then be a five-day period before the treaty cancellation is considered final.
D. Termination of this treaty shall not be seen as an act of war or hostility by either side.

Preamble

Desiring friendship and tranquillity between Lazarus and the South Pacific, both parties ratify this treaty and thereby affirm their mutual respect.

Section 1. Recognition of Sovereignty

(1) Both signatories recognize the government of the Coalition of the South Pacific as set forth in the Charter and the government of Lazarus as set forth in the Twelfth Mandate as the legitimate ruling bodies of their respective regions.

Section 2. Pact of Non-Aggression

(1) All amendments to this treaty must be made bilaterally following negotiations between signatory governments.

(2) The parties to this treaty may clarify the terms of this treaty through memorandums of understanding, which shall be posted alongside the treaty.

(3) Should either signatory state voluntarily disband without leaving a legal successor or dissolve this treaty in accordance with their own laws, both parties shall be relieved of the commitments made herein.

(4) This treaty shall be displayed in a publicly accessible area of the community forums of both parties.

Whereas the Governments of The North Pacific and Lazarus, hereafter jointly referred to as "the signatories", are cognizant of their shared status as governments of the game-created regions; and

Whereas the signatories wish to develop closer ties with one another through continued discussions, as well as the undertakings set forth herein;

Therefore, the signatories agree as follows:

Section I - Mutual Recognition

1. The signatories acknowledge the constitutional governments acting at the time of ratification of this Pact to be legitimate and sovereign governments of their respective NationStates regions.

2. The signatories will maintain their established in-game embassies (i.e., on the NationStates site) and off-site embassies (i.e., on their respective regional forums) with each other.

Section II - Non-aggression

1. The signatories will not engage in any military hostilities against one another’s home regions, their event regions, jump points, or any other regions owned by the signatory.
Participation on opposing sides of a military engagement that does not involve an attack on any of the above qualifiers shall be exempt from the above requirement.

2. The signatories will not attempt to subvert or undermine one another's legitimate and sovereign governments in any form.
The signatories will not in any way initiate or participate in espionage, subterfuge, or other clandestine operations against one another. For this purpose, a "clandestine operation" is one or more persons acting under false pretenses in one signatory's home region or regional forum, without that signatory's knowledge, and at the behest of the other signatory.

Section III - Communication

1. In the event of a security-related contingency or compromise of another feeder, sinker, or mutual ally, the signatories will inform each other of their respective positions and share pertinent information regarding the matter without unduly risking sensitive information or jeopardizing operations.
1.1 All information shared shall be kept confidential for use of the receiving signatory’s government only unless the release of such information is explicitly allowed by the providing signatory

Section IV - General Provisions

1. This Pact shall come into effect upon its ratification by the duly authorized individuals or bodies of both signatories.

2. The signatories reserve the right to nullify this pact with the approval of their duly authorized individuals or bodies. In the event of such, the nullifying signatory must notify the other as soon as practicable

Treaty of Connacht

Article 1. Mutual Recognition

  1. Caer Sidi and its legal successors shall recognize the government established by the Twelfth Mandate of Lazarus and any of its legal successors as the legitimate government of the region of Lazarus.
  2. The government established by the Twelfth Mandate of Lazarus and its legal successors shall recognize the Caer Sidi government and any of its legal successors as the legitimate government of the region of Caer Sidi.
  3. Should the government of a signatory voluntarily disband while in exile, the other is freed from the commitments of Article 1, Sections 1 and 2.
  4. Additionally, if the new government of said signatory refuses to recognize this treaty, it shall be automatically dissolved.

Article 2. Non-Aggression Pact

  1. Both signatories hereby pledge to not invade, raid, or otherwise attack the other’s region or any possessions they may have, nor aid any faction, government, or party to do so.
  2. Both signatories agree that the deployment of military forces on the opposite side of the other in another region that is not the possession of either does not constitute aggression against either of the signatories.
  3. If planned and agreed upon by the governments and military forces of both signatories, both military forces may engage in offensive raiding or defending action against each other for training purposes, and thus this action shall not constitute an act of aggression.

Article 3. Mutual Defense and Assistance
  1. Both signatories pledge to defend one another militarily against any invasions or similar crises they may suffer.
  2. Both signatories pledge to send any military forces they possess at the request of the other in order to facilitate legitimate delegacy transitions, or in cases of emergency.
  3. Both signatories agree that they shall not aid an enemy at war with the other. If a region declares war on one of these signatories, the other may only choose to stay neutral or aid the signatory in question.
  4. If one of the signatories does not possess any military forces and is called upon the other by the provisions set in Article 3, Sections 1 to 3, they must assemble a military force at the earliest opportunity.

Article 4. Joint Operations
  1. Both signatories may partake in joint military operations for training or their mutual enjoyment. The relevant laws, codes and regulations governing each signatory’s military forces shall remain in force in such operations, and thus neither of the signatories may commit any act that may force the other signatory to break said relevant laws, codes and regulations governing their own military forces. If such an act is planned, the signatory that shall commit this act must inform the other signatory of the act in question so the other signatory can withdraw their forces as soon as possible.

Article 5. Regional Security

  1. Both signatories pledge to inform the other’s government and any relevant intelligence services of any evidence they may have of espionage, infiltration, subversion, manipulation, or conspiracy against the other. They shall also inform the other of any conspiracies to commit any crimes in the other’s jurisdictions.
  2. Both signatories pledge to cooperate on matters of intelligence and security.
  3. Both signatories shall condemn any acts of espionage, infiltration, subversion, manipulation, or conspiracy against the other if the target of these acts confirm it.
  4. Both signatories pledge to never commit acts of espionage, infiltration, subversion, manipulation, or conspiracy against the other, or aid any faction, government, or party to do so.
  5. If the government of any of the two signatories fail to fulfill the obligations of Article 5, Sections 1 to 4, they must formally and publicly apologize for this.

Article 6. Cultural Cooperation

  1. The relevant cultural authorities of both signatories shall actively cooperate on matters of culture, which may include festivals, games, roleplays, mafia, newspapers, radio shows, podcasts, graphic design, and others. Furthermore, the relevant cultural authorities of both signatories are strongly encouraged to do more than the required one bilateral event per year.
  2. Citizens of Lazarus and Caer Sidi are welcome to visit the other’s region and engage in events of cultural significance and to have fun with the other’s community.

Article 7. Provisions of Ratification, Amendment and Repeal
  1. Both signatories shall activate their legal mechanisms relevant to ratify a treaty after they agree to do so.
  2. If a signatory wishes to amend this document, they must negotiate with the other to do so. After this, the same legal mechanisms in each region relevant to ratify a treaty shall be activated to adopt these agreed amendments. If one region refuses these amendments, they are to not be adopted.
  3. If a signatory wishes to dissolve this treaty, they must notify, by any means of communication available and possible, their intention to dissolve said treaty to the other. After this, the legal mechanisms relevant to dissolve a treaty shall be activated in the region of the requesting signatory.
  4. The signatories may dissolve this treaty by mutual consent. The legal mechanisms relevant to dissolve a treaty must be activated, and if at least one region decides to repeal, the treaty is declared null and void with immediate effect.
