Military Expansion Act (November 2019)

Preamble

This act integrates the command structure of the Lazarene armed forces into the newly inaugurated democratic government and establishes guidelines for its conduct and future expansion.

Section 1. Military Reorganization

(1) The armed forces of Lazarus shall be officially renamed from the Lazarene Guard to the Lazarene People's Army.

(2) The Lazarene People's Army shall be directed and coordinated in the field by a Supreme Commander, who must be a citizen of Lazarus with a residency of at least 4 months.

(3) The Prime Minister reserves the executive prerogative to appoint and dismiss the Supreme Commander, subject to confirmation by a 50%+1 vote by the Assembly of Lazarus.

(4) The position of the Supreme Commander may not be immediately affected by changeover of the ruling administration, unlike the elected officials that the Supreme Commander is responsible to.

Section 2. Martial Conduct

(1) The Lazarene People's Army may engage in martial action befitting of raiders, defenders, or mercenaries depending upon the standing executive policy of the incumbent Prime Minister.

(2) The Lazarene People's Army may be automatically deployed to execute a military action at the order of the Prime Minister prior to an official declaration of hostilities against a foreign government, but the Prime Minister shall be compelled to recall all armed forces if a proposal to enact a declaration of war fails to pass through the Assembly of Lazarus within a 3-week time period from the start of troop deployment.

Section 3. Provision for the Establishment of Additional Military Departments

(1) The Prime Minister reserves the sole prerogative to propose legislation to establish, disestablish, or regulate new or existing departments of the Lazarene armed forces.

(2) The Prime Minister may establish directorates to organize the tasks of espionage, counterespionage, and intelligence-gathering, with confirmation from a 50%+1 vote by the Council of Lazarene Security. Both proposals of this character and the voting thereupon shall be conducted secretly in a secure private offsite forum.

I didn't see anything explicitly establishing guidelines for regulation or control of the military corps in Mandate 12 or anywhere else. Please go easy on me. I'm new.
 
The Charter of the Lazarene Regional Guard (December 2018) establishes the Guard, defines its structure and regulates it. In order to make the changes you're trying to, your proposal ought to be an amendment of that-since it's a constitutional law, that requires a three-quarters majority.

I would suggest that an amendment transferring control of the Guard to the Prime Minister and an amendment widening its scope should be two different proposals, since one is basically housekeeping and the other is a highly contentious issue.

On that topic, I will be voting nay on any amendment that seeks to deregulate the Guard. Many new members amongst its ranks want to abandon Lazarene neutrality in favour of flawed independence, not understanding that this will divide many long-standing natives of Lazarus as they were divided before and inevitably lead to alignment, alienating some of those members completely. I worry that their voices have not yet been heard.
