Prime Minister Powers and Responsibilities Amendment (2022)

Section 1. Amendment of IV. Executive Council

(1) IV. Executive Council shall be amended to include:

Establishment of the Prime Minister's Cabinet

(5) The Prime Minister shall appoint at least two Cabinet Ministers, one tasked with internal affairs, and one with foreign affairs. Appointment of Cabinet Ministers, excluding Deputy Ministers, will be subject to confirmation by 50%+1 vote of the Assembly.

(6) Cabinet Ministers, including Ministers and Deputy Ministers, will serve until the end of the Prime Minister's term or until resignation, removal from office by the Assembly or the Prime Minister, or automatic removal from office. Further regulation of appointment or removal of Ministers and Deputy Ministers may be established by law.

(7) The Prime Minister may appoint additional Ministers, Deputy Ministers, and officials to Ministries to assist with executive duties, programs and activities, and may provide for their appointment and removal.

Establishment, removal or renaming of Ministries

(8) The Prime Minister may establish, remove, or rename Ministries at will. The Prime Minister may reassign or remove any Ministers, Deputy Ministers, and officials, when establishing, removing, or renaming a Ministry.

Composition of the Executive Council

(9) The Prime Minister will be appointed to the Executive Council and may allow Cabinet Ministers to participate on the Executive Council.

(10) The Delegate and Vice Delegate shall be permanent members and chairs of the Council until they are removed by three-quarters vote or resign from office.

(11) In accordance with the procedural rules of the Council of Lazarene Security, a member from their number shall be designated to serve on the Council as a security advisor.

(12) In accordance with the procedural rules of the Court of Lazarus, a member from their number shall be designated to serve on the Council as a legal advisor.

(13) Membership on the Executive Council will not restrict participation in another office.

Given the recent court decision, we should precisely specify what a Prime Minister cannot do, and what they should be allowed to do.

Notably the situations where a PM should be allowed to dismiss/appoint a Minister or Deputy Minister, and situations around establishing, removing, and renaming Ministries.

Considering whether this should be added:

Further regulation of appointment or removal of Ministers and Deputy Ministers may be established by law.

Just in case we want to decide more circumstances in legislation where a Minister or Deputy Minister might be removed or require further requirements to be appointed.
