How I interpret the law is that the Grand Advisors are to be reconfirmed every 4 months and a vote of no confidence results in their recall. However, from what I can find unless the thread is hiding somewhere or was deleted the last reconfirmation vote was 7 months ago. The law seems to state what happens with a vote of confidence and a vote of no confidence but what happens when there is no vote at all? It seems that they haven't lost the confidence of the Assembly, but they also haven't received it. Please correct me as well if I just did a dumb and couldn't find a more recent reconfirmation or if I'm missing something else obvious. |

In my personal opinion, this is not a question of Constitution or law and thus does not fall within the jurisdiction of the Grand Court. The Mandate is unambiguous, there should be a vote on confidence every 4 months. As to why that has not occurred recently is beyond this Court to determine. I recall that there was a brief discussion in the Grand Assembly regarding this matter a number of months ago. That discussion appears to have been overtaken with what I am assuming, was more pressing concerns at that time, and was relocated to 'past discussions'. I advise you bring this up with the acting-Director of Ceremonies or create a thread in the Assembly to highlight this issue. Edit: I reread the opening post and noticed that I did not answer the question you posed. The Mandate does not specify what would happen if a vote does not occur. There is no enforcement mechanism. Hypothetically, the Court could compel with urgency the compliance of this clause in the Mandate but it would ultimately be up to the Grand Assembly to act and fulfil their Constitutional duty. Silence implies consent, as they say. In other words, the Grand Advisors are presumed to have the confidence of the Grand Assembly, because the Grand Assembly did not hold a vote on the matter. Also, I believe an amendment has been proposed to address this matter. |

I think the Mandate is pretty clear in this case. A vote of confidence should be held every 4 months |

I apologize if I was unclear. I understand the requirement. My question was what happens when the vote isn't held? Edited by Altmoras, May 9 2016, 12:40 PM.

Nothing. There are no stated consequences. |

I was kinda asking the Court on that one, but thanks for your input. I do have a question for you though Cal, why haven't you held the vote at any point in your tenure as DDoC? |

Although I had seen it in the mandate no DoC was really doing it so I assumed we got rid of it or something. |
