Court Inquiry re: GOF; Court Inquiry into alleged criminal activities

The full bench of the Court is in agreement that proceedings will go forward to reexamine the feasibility of perusing a criminal case into the alleged crimes committed by what is commonly known as the Gang of Five.

For the record, the Court acknowledges a prior criminal complaint filed by The Church of Satan as being the basis for this inquiry. The complaint filed accuses Stujenske, Feux, Pergamon, Milograd/Yao, A Mean Old Man of aggression, harassment, subversion, conspiracy, fraud, forum destruction, and deserting the then administration.

At this time, the Court seeks a citizen of Lazarus to come forward and volunteer their services as a representative of the public and to operate in the capacity of prosecutor for the duration of this case.

Bold mine. Is that to literally say the premises, both logical and judicial, of a potential trial are going to be examined, or that you're just going to pursue a trial?

At present, a majority of Justices are uncertain if it is judicially legitimate for a Court of the Humane Republic of Lazarus to preside over a trial of individuals accused of crimes allegedly committed in the era and under the judicial code of the People's Republic of Lazarus.

The Court invites submissions by interested parties to address the aforementioned question. Please have these briefs submitted in 72 hours of this post so the Court can make an informed determination.

What is the point in having a "prosecutor" if there is no legal need to have one? The entire basis of this court is to do the fact finding, not having someone do it for them.

I've spent a year trying to ban the Gang of Five from Lazarus via clauses in the original Mandate, via an amendment to the mandate, and via statute, only to be told over and over that the Grand Court is the best/correct/only legitimate way to go, and now you're not sure it would be legitimate to try them under their own laws?

A year of delay, obfuscation, foot-dragging and excuse-making does not engender confidence in the Grand Court. The task before you is simple: examine the evidence and decide whether the members of the Gang of Five, individually and/or collectively, violated the People's Republic of Lazarus laws they are accused of breaking; and if you find they did, recommend punishments according to those same laws.

I urge you to get to it.

I agree; some members of the Grand Court seem intent on ignoring the Unified Legal Code, specifically:

Article II - Judicial Inquiries

(1) All Criminal, Civil and Legal matters will be dealt with via Judicial Inquiry.
(2) All Judicial Inquiries will be conducted by a tribunal consisting of the Chief Justice and two Associate Justices.
(3) The purpose of a Judicial Inquiry is always to establish the facts of the matter, and then resolve the issue. All Judicial Inquiries will be conducted publicly via a non-adversarial hearing.
(4) All Judicial Inquiries will run for a minimum of seven days, and may be extended beyond this at the discretion of the Chief Justice.


Indeed it seems that a trial, as such, would be illegal!
