Constitutional Proposal for the Royal Republic of Lazarus


Preamble

We, the Citizens and Revolutionaries, Democratic and Monarchist, of all walks of life unify to build the Royal Republic of Lazarus. We stand in defiance of the foreign agents who had attempted to put us under their boot, united in just cause with the safety of our homeland in mind. As such, we hereby affirm belief in this document as our governing document, from which all state power originates.


Article I: The Royal Republic

I. The Royal Republic of Lazarus, henceforth referred to as the RRL, shall officially replace the People's Republic of Lazarus upon the adoption of this document.

II. The RRL will have all rights to the governance of the region of Lazarus, affiliated forums, documents created by the RRL, and chat rooms created or made official by the RRL

III. Members with nations in the region of Lazarus, who have applied for citizenship and met the parameters set forth by the RRL government shall be known as Citizens.


Article II: The Rights of Citizens

I. All Citizens shall enjoy the freedom to speak and write freely, but shall also enjoy consequences of the law if such free speech causes harm or endangers the state.

II. All Citizens shall enjoy the right to be in the World Assembly, so long as they abide by the cap placed on them by the government of the RRL.

III. All Citizens shall enjoy the right to partake in elections so long if they joined the region prior to the opening of nominations.

IV. All Citizens shall enjoy the right to a speedy trial, but may be subject to a ban if the administration team deem it necessary beyond a reasonable doubt.

V. All Citizens shall enjoy the right to partake in any public referendum brought forth by the Assembly.

VI. All Citizens shall enjoy the right to refuse to serve on a jury based on scheduling reasons or bias.

VII. All Citizens shall enjoy the right to not be tried again on the same instance if found not guilty previously.


Article III: The Administration Team

I. The Administration Team is defined as the group of citizens that are charged with running the technical aspects of the offsite forum and chat rooms. They shall be known as Administrators

II. Administrators shall be broken down into two separate groups. These groups are Forum Administrators and Chat room Administrators.

III. The head of this team shall be known as the Head of the Administration Team.

IV. The Head of the Administration Team shall be charged with ownership of the official forums, having control of the ROOT account. As such, the successor of the Head of the Administration Team shall be selected by the Head from the Administration Team.

V. Administrators must apply and meet standards to be appointed to a position on the Administration team.

VI. The only prerequisite of the successor to the Head of the Administration team shall be that this person must demonstrate knowledge of the workings of both forums and Internet relay chat rooms.

VII. Administrators may not use their power to disrupt or interrupt the political process of the region, nor use any past personal bias in any case against an individual that pose no inherent threat to the region.


Article IV: The Royal Government

I. The Royal Government shall serve as the executive body of the RRL

II. The Royal Government shall be formatted and named under the Monarch who leads the Government.

III. All executive power rests within the Monarch.

III. The Head of the Royal Government shall be the Monarch, and may use, within reason, any title to define their seat as so long as it includes the phrase “of the Lazarenes”.

IV. The Monarch shall be the regional delegate of the RRL, as well as the official head of the Military.

V. The Monarch shall appoint a cabinet to maintain the various departments created by the Royal Government

VI. The Monarch is held responsible by the Regional Assembly.

VII. The Monarch may not disband or create offices of state under the Royal Government without first consulting the Regional Assembly.

VIII. The Monarch shall enjoy the right to appoint judges to the courts with the consent of the Regional Assembly.

IX. Heads of the various created state offices shall be known as Secretaries. Those who serve in those departments, but head a subsection of these departments shall be known as Ministers.

X. The Royal Government must maintain a regional guard, comprised of citizens who have resided here for an extensive period of time and who are loyal to the RRL. Those deemed such shall enjoy an endorsement cap higher than that of a normal citizen, but lower than the Monarch.

XI. Those appointed to the regional guard must be approved by the Regional Assembly.

XII. The Monarch shall serve a four month term, and may not serve more than two consecutive terms in office.

XIII. Any titles given out by the Monarch must be approved by the Regional Assembly.


Article V: The Regional Assembly

I. The Regional Assembly shall serve as the legislative body of the region.

II. The Regional Assembly shall be elected to two month terms, and be allowed to serve without term limit.

III. The number of Regional Assembly members shall be set at seven members.

IV. The Regional Assembly must elect a Speaker from their ranks to serve as the leader of the Assembly as defined by internal rules.

IV. The Regional Assembly must set forth the rules for itself at the first Regional Assembly meeting following the passing of this document.

V. With each election of the Regional Assembly, the rules of the Assembly will be opened for edits. Once edited, rules may not be edited again without eighty percent of the chamber in approval.

VI. Each bill, excluding constitutional amendments, removals, and recalls, must receive over fifty percent of the Regional Assembly in favour of the bill.

VII. The Regional Assembly shall enjoy the right to initiate a vote of no confidence on the Monarch. These votes shall be accepted with an eighty percent approval of the Regional Assembly.

VIII. With a simple majority, the Regional Assembly shall be allowed to revoke the titles of a citizen of the region if they have been granted one previously by the Monarch.


Article VI: The State Court

I. The State Courts shall serve as the judicial branch of the RRL

II. The State Courts shall be staffed by up to three members. The leader of the State Courts shall be known as the Chief Justice. Those under the Chief Justice will be known as Associate Justices

III. The Chief Justice may not serve in any other elected or appointed position for the duration of their term.

IV. The State Courts shall hear all civil and criminal suits filed against any legal body or person(s) within the state.

V. The State Court shall default to a tribunal system of court ruling in a case, unless either the plaintiff or defendant requests a trial by jury, then a jury consisting of five citizens shall be selected at random.

VI. If the State Court cannot muster a jury within seventy-two hours, the trial shall default to a tribunal system.

VII. The State Court may set forth a bar if they deem necessary.

VIII. The State Court may not set or alter the bar during any legal procedure.

IX. In the instance where a member of the State Court cannot be present for legal proceedings, the Regional Assembly may appoint someone to fill the vacant position. If more then two Justices are not present, the legal action shall be frozen until a time in which the Justices may process the case.

X. The State Courts shall provide a legal representative to those who are unable to acquire one.


Article VII: Motions of Removal

I. The Citizens hold the right to initiate a recall.

II. To recall a member of the Regional Assembly, the Citizen lobbying for their removal must provide reasons that are acceptable to common sense.

III. If a vote is accepted under provision II, a vote shall be started.

IV. A recall must achieve sixty percent of the current citizen population to succeed. If a motion succeeds, the member recalled shall immediately be revoked of all rights to their seat in the Regional Assembly and registration for a by-election to fill the vacant seat shall begin.

V. The Regional Assembly holds the right to initiate a motion of no confidence on the Monarch.

VI. To initiate a motion of no confidence, the Regional Assembly member lobbying for their removal must provide reasons that are acceptable to common sense.

VII. If a vote is accepted under provision IV, a vote shall be started in the Regional Assembly. If the vote reaches the eighty percent threshold, the Monarch shall have lost the confidence of the Regional Assembly.

VIII. The motion shall then be voted on by the citizens. If the citizens vote past the eighty percent threshold, the Monarch shall have lost the confidence of the region. An election for the new Monarch shall begin immediately following the passing of the vote of no confidence.

IX. Citizens who arrived one week before the initial motion of removal shall be barred the right to partake in the removal process.

X. Any person removed from their position in a motion of removal shall be permitted to run immediately following their removal.

XI. Justices may be recalled by an eighty percent majority of the Regional Assembly.

XII. Justices may not be recalled until at least two weeks following a ruling, to ensure that any vote to remove is not based on personal intentions of any Regional Assembly member.


Article VIII: The Military

I. The Military shall be known as the Lazarene Liberation Army, and shall be referred to henceforth as the LLA.

II. The Military stance of the RRL shall be defender.

III. The Commander-in-chief of the LLA shall be the Monarch.

IV. The Monarch shall appoint a leader to lead the LLA under them.

V. The appointed commander shall enjoy the rights to create all ranks, manage recruitment, plan missions, execute missions, commission officers, contact other organizations, and train those in the LLA.

VI. The Monarch may recall the appointed commander, but this removal must be approved by the Regional Assembly.


Article IX: Elections

I. Elections shall be held on the first Friday of the month.

II. Elections shall be overseen by the Chief Justice.

III. One week before a scheduled election, registration shall be opened to those eligible to run.

IV. Those running for the position of Monarch must have resided in the region for at least one month.

V. Citizens running for position shall be allowed to campaign from the opening of registration until the opening of the polls.

VI. Elections shall run for a total of forty-eight hours, starting at midnight GMT on Friday

VII. By-elections shall be opened only when a vacancy occurs in any elected position.

VIII. By-election registration shall start five days before an election.

IX. In the event of a tie, a run-off vote shall be declared. The run-off shall last forty-eight hours.


Article X: Constitutional Amendment

I. Constitutional Amendments must be presented to the Regional Assembly, and must pass with a simple of the Regional Assembly.

II. Upon an amendment passing in the Regional Assembly, the vote shall be given to citizens who shall approve the amendment with an eighty percent vote.

III. If a Constitutional Amendment is failed, than it may not be reintroduced in the same session.


I'm very late, as it seems, and decided to write this anyway. I am curious to how this'll be received. Feel free to hate/love/like/dislike this document, and by extension, my monarchist self :P

I really like the idea of a monarchy for a region but it doesn't feel like a right match for Lazarus.

This was an idea I had prior to losing my hard drive, so I decided to write it regardless. I came back on and straight went to writing it, and then realized that this was already going on, but still posted this anyway.
