An Act to Update, Standardize, and define the Legal Code
1. In Character
1.1. Alliances
1.1.1. Recruitment
1.1.1.1. Recruitment of nations or individuals into an alliance or organization must be conducted professionally; without slander or defamation of other alliances, nations, individuals, or organization.
1.1.1.2. All individuals or nations being recruited into an alliance or organization must be presented with enough information to make an educated decision.
1.1.1.2.1. The recruiter must make all policies, methods, and other information regarding the operation of the alliance public to the nation/nations or individual/individuals being recruited.
1.1.1.2.2. The recruiter of the alliance or organization must make public the possible repercussions and effects that the induction into the alliance or organization will have upon the persons in question.
1.1.2. Transparency
1.1.2.1. The alliance or organization must make public all information regarding the alliance or organization in question.
1.1.2.1.1. All information regarding the membership of all past, present, and planned members of the alliance or organization must be made public.
1.1.2.1.2. All alliances or organizations must declare all enemies or allies of the alliance or organization in question.
1.1.3. Restrictions
1.1.3.1. Any nation or individual that has not resided in the region for a period longer than ten days, or does not have a spot on the map, may not join an alliance or organization until such time has passed.
1.2. Roleplay
1.2.1. Joining a Roleplay Thread
1.2.1.1. All individuals wishing to join a roleplay thread are required to read the entirety of the thread. Furthermore, all individuals returning from a hiatus to the roleplay thread are also required to reread the thread.
1.2.1.2. Before posting or indeed composing a post for the thread in question, all individuals wishing to join must notify and ask permission from the OP of the thread.
1.2.2. Posting in a Roleplay Thread
1.2.2.1. All individuals posting in a roleplay thread must have obtained previously obtained permission to do so from the OP of the thread.
1.2.2.2. Persons posting in the thread are required to write a post composing of a minimum of eight sentences, and more than two lines, depending upon the current status of both the poster and the thread.
1.2.2.3. Persons editing a post are restricted from doing so without having previously notified the participants of the roleplay thread that the post in question is in with the intention and explanation of the edit. This applies to all individuals, including those in positions of administration or moderation.
1.2.2.4. Persons are restricted from conducting any OOC discussions and conversations in an IC thread. Any and all OOC comments in an IC post must be designated by the prefix “OOC:”, and are restricted to being simple explanations, small comments, or quick questions about the thread or post in question.
1.2.3. Realism in Roleplay
1.2.3.1. Any and all participants of any roleplay must adhere to the standard rules of roleplay regarding realism. Any and all posts must be composed in a realistic manner to the best of the writer's ability. Questions regarding the reality of the post are to be made to the appointed fact checker.
1.2.3.1.1. Likewise, national equipment, technology, and canon must comply with the laws of realism regarding whether the technology, equipment, or canon can exist physically, rather than the feasibility of the technology, equipment, or canon in question.
1.2.3.1.2. Should an individual’s post or technology be declared unrealistic and therefore illegal, the persons in question are required to edit their post or Factbook to comply with the request.
1.2.4. Canonicity of Roleplay and Events
1.2.4.1. All actions and posts made in the threads and sub forums not otherwise designated are considered canon.
1.2.4.2. Any and all major events that affect the individual’s nation, both internationally and intranationally, must be made public in the news thread to be considered formally canon. This does not apply to minor events regarding persons, cities, or transactions in the individual’s nation.
1.2.5. Restrictions
1.2.5.1. Individuals are restricted from posting any action or event that would be physically impossible to achieve or happen in real life without specific requirements being met. Such actions are referred to as Godmoding.
1.2.5.2. Individuals are restricted from making any posts that is influenced by, or made in response to, knowledge obtained through OOC means that could not have been obtained through any other means. This is known as Metagaming.
1.2.6. Description of Terms and Abbreviations used in Roleplay.
1.2.6.1. Godmodding
indent] 1.2.6.1.1. Godmoding is the execution of otherwise impossible actions. The term comes from video games, were a person could enter a God Mode where the laws of physics did not apply. For example, a soldier survives a direct headshot, or a tank moves too fast. A good rule of thumb is, if it is not possible in real life, it is not possible in the roleplay.
1.2.6.2. Metagaming
1.2.6.2.1. Metagaming is the writing of a post that has been influenced by OOC knowledge otherwise not obtainable by IC means. Such an example would be telling an individual of the plans of attack he shall execute, and the individual in question directly plans his post in response to that knowledge.
1.2.6.3. Abbreviations
1.2.6.3.1. RP=Roleplay, which is defined as the writing out of actions which are responded to, or are responses of, other persons’ posts. OOC=Out of Character, which is defined as writing that is not in the point of view of characters or is not the description of actions and events. Likewise, IC=In Character, and is writing that is done from the point of view of characters, or is a description of actions or events.
2. Out of Character
2.1. Regarding Nations
2.1.1 Nations may not participate in roleplay if their nation does not have a place in the map for any reason.
2.1.2 If a nation ceases to exist in Nationstates, then the nation shall be removed from the map as soon as possible.
2.1.3 All nations listed in the offsite forums are bound by their main nation in the region. Should that main nation move out of the region without alerting a member of the administration, the nation shall be removed from the map as soon as possible.
2.2. Code of Conduct
2.2.1. Do not flame. Flaming is defined as aggressively and angerily posting with the intent of insulting another individual.
2.2.2. Do not spam. Spamming is defined as posting needlessly, either by repeating phrases, or posting consistently where not allowed.
2.2.3. Do not harass. Harassment is akin to trolling, where an individual consistently makes statements to insult, upset, or anger another individual, or consistently spams them.
2.2.4. Do not bait. Baiting is making a statement that aims to make the other individual angry intentionally.
3 The Court
3.1. Description
3.1.1. Description of the Court
3.1.1.1. The Courtroom is an environment in which two legal parties, the defendant and the prosecution, may voice legal concerns, requests, or punishments about the other in a civil, enforced, and regulated manner in the presence of an appointed judge and jury of good legal standing.
3.2.1. Explanation of terms
3.2.1.1. Defendant: The defendant is the legal party of which the court case is directed towards.
3.2.1.2. Prosecutor: The prosecutor or prosecution is the legal party, either an individual or the government, that is making a court case against the defendant
3.2.1.3. Civil Court: The Civil Court is the court in which an individual may be sued by another individual.
3.2.1.3. Criminal Court: The Criminal Court is the court in which an individual is put on trial, having been accused of breaking one or more of the laws laid out in the Legal Code.

3.4.1. Courtroom Procedure
3.4.1.1. The Jury must always be consisting of ten members of good legal standing, and must not be in anyway involved in the case in motion. Exceptions may be used if ten impartial members cannot be found.
3.4.1.2. An individual may not be tried for the same crime twice or more. If a member has been found innocent of a crime, the court may not convene again to put on trial that same crime.
3.4.1.3. In the presentation of a case, there may be no hidden charges. All accusations of illegal or harmful activity must be presented for all to see. Any accusation that is not presented in the duration of the trial, or during the sentencing phase, cannot be ruled or sentenced upon.
3.4.1.4. The defendant must be notified of his/her condition, and the charges against him/her, prior to the presentation of the case.
3.4.1.5. All individuals, citizens, and members are guaranteed the right to a fair, public, and procedural trial. Any trial that is not conducted according to the rules and procedures laid out in this document is to be considered null and void by both parties, and any sentencing or rulings derived from that trial are to be reversed.
3.4.1.6. All Criminal Cases must include a charge or rule that is in the legal code at that time. If not a documented or public law, then the court may not try a person of that charge.
3.4.1.7. The defendant is to be considered innocent until proven guilty, and punishments or reparations must not occur before the ruling or sentencing.
3.4.1.8. During the trial, the defendant is not required by any law to testify against him or herself. Any member who violates that rule by forcing or coercing the defendant into testifying shall be charged with perjury.

My proposal so as to not intimidate newcomers and to seperate the spheres of forum behaviour and role play is to take what Caos has written, with a few slight amendments and have two seperate codes. A "RP Code" will govern role play and a "Legal Code" will govern forum behaviour.

To sum up the amendments Legal Code 1. Change from someone being on the map to start RP, to someone having made an approved map claim. Should cartographer go on a LOA or be inactive it still permits new people to get involved. 2. Reminder added that code applies to all aspects of Audaxia 3. "Use of Court" & "Process of Court" sections seemed to be empty, additions made. 4. Jury reduced from ten to three considering the activeness of our region. Roleplay Code 1. Removal of some rules as I personally believe they are common sense and having too many seems daunting and puts of new comers, the issues they governed such as post lengths etc can be easily dealt with by encouraging and helping new comers rather than enforcing limits. 2. Making it easier to join threads marked OPEN. Incidentally many of us have broke the old code by joining Open posts without asking first. 3. Shortening of some rules to make the document briefer.
